Two Ways to Divorce in Ukraine
The path depends on whether you have joint children and whether your partner agrees:
Through the registry office
Possible only if you have no joint minor children and both spouses agree. The fastest route — about 1 month. We prepare the application and accompany you to the filing.
Through the court
Required if there are children or one spouse objects. The lawyer drafts the petition and represents your interests in court — often without your presence.
Turn-key divorce without your presence
Most clients prefer not to meet their former partner in court. With a notarised power of attorney, we run the case fully on your behalf:

Almost no divorce involving children or joint assets is limited to dissolving the marriage. We handle all related matters within a single proceeding:

Divorce through the registry office (no children, no disputes, mutual consent) takes about 1 month. Through the court — on average 2–4 months, depending on disputes about children, alimony and property, and the court's workload. Complex cases may take 6 months or longer.
No. If there are joint minor children, divorce can only be granted by a court, even if both spouses fully agree on every issue.
Yes. Ukrainian law prohibits forcing anyone to remain in a marriage. The court may grant a reconciliation period (up to 6 months), but if at least one party insists on divorce, the marriage will be dissolved.
Yes. With a notarised power of attorney, an O'LAW lawyer runs the case fully on your behalf. This is especially relevant if a spouse is abroad, serving in the military, or simply wishes to avoid contact with the other party.
Property acquired during the marriage is divided equally, regardless of whose name it is registered under. Exceptions are personal property (inherited, gifted, or owned before marriage). Division is formalised by a notarised agreement or through the court. A prenuptial agreement can establish a different order.
The sole proprietorship status itself is not divided, but business income earned during the marriage and assets bought for the business belong to joint property and are subject to division. An LLC share can also be divided. Business protection is best addressed in advance through a prenuptial agreement.
An O'LAW lawyer obtains a duplicate of the marriage certificate from the registry office under a notarised power of attorney. The absence of the original is not an obstacle to filing the petition.
