An uncontested divorce through the registry office (no children, no property disputes, mutual consent) takes about 1 month. Through the court — 1 to 6 months depending on disputes over children, alimony and property. Divorce involving a foreigner is a separate procedure, on average 2–4 months.
Yes. If one spouse is abroad or cannot attend court for valid reasons, an attorney represents their interests under a notarised power of attorney. This is especially common for divorces involving foreigners and military personnel.
Child alimony is set as a share of income (typically 1/4 for one child, 1/3 for two, 1/2 for three or more) or as a fixed amount. The minimum is 50% of the subsistence minimum for a child of the relevant age. Alimony can be agreed voluntarily (notarised agreement) or ordered by the court.
Property acquired during the marriage is divided equally, regardless of whose name it is registered under. Exceptions are personal property (inherited, received as a gift, or acquired before the marriage). Division is formalised by a notarised agreement or through the court. A prenuptial agreement can establish a different order.
Decided by parental agreement or through the court. The court considers the child's age and attachment, relationships with each parent, living conditions, and moral qualities. The opinion of a child aged 10 or older is mandatory.
Yes. A prenup can be challenged if it places one spouse in an extremely unfavourable financial position, was signed under duress, deception, or in a state where the person did not understand the consequences. The dispute is resolved in court.
