Prenup Myths vs Reality

In Ukraine, prenups still carry old stereotypes. Let's break the main ones:

"It's a step toward divorce"

Reality: it's a stability tool. Spouses agree upfront so they can live in peace without arguing who pays the credit or on whose mother's name the apartment is registered.

"A fine for cheating"

Reality: no. The agreement covers property matters only. No clauses about personal life or fidelity can be included — the court would invalidate them.

"Only for the wealthy"

Reality: needed by anyone with an apartment, car, business, sole proprietorship, mortgage plans, or gifts/inheritance from family.

"It's insulting"

Reality: in Poland, Germany, the US, a prenup is a standard part of wedding preparation — like a medical check-up or choosing a venue. Ukrainian attitudes are catching up.

What CAN Be Included in a Ukrainian Prenup

Ukrainian Family Code allows deviation from the default "everything 50/50" rule. The prenup can regulate:

  • Marital assets: property acquired with personal funds remains personal.
  • Premarital assets: clear record of what belonged to whom at the start.
  • Business & sole proprietorship: protection of corporate assets, shares, intellectual property.
  • Debts & credits: who is responsible for mortgage, car loans, business credit.

  • Support: financial support for one spouse (e.g., during parental leave).
  • Disposal rights: who may sell, gift or pledge specific assets.

What CANNOT Be Included

The prenup cannot regulate personal non-property matters (fidelity, cohabitation, intimacy), restrict legal capacity, determine child residence or upbringing, or place one spouse in an extremely unfavourable financial position. The court will strike out such clauses — and the entire agreement risks falling apart with them.

A prenup can be signed at any convenient moment: before the marriage registration (it then takes effect on the wedding day) or during the marriage itself. The law sets no restrictions based on the length of cohabitation.
You can regulate property matters only: regime of joint property, premarital assets, business, credits, support. You cannot determine child residence, regulate personal relations, restrict the legal capacity of one spouse, or place one spouse in an extremely unfavourable financial position.
Yes. Spouses can at any time mutually amend or terminate the agreement — it is done through a notary. Unilateral termination requires court action, possible if statutory requirements were breached.
